Acceptable use policy
Effective 2026-10-04. This policy is part of our terms of sale and use. It applies to every file and sample you get from nodilist, to anyone who uses the data on your behalf, and to any list you merge the data into. It summarizes rules you must follow. It is not legal advice, and the law that applies to your outreach is your responsibility.
1. Business use only
- Use the data only to contact businesses and professionals about products and services relevant to their work, for market research, or to keep your own business records current.
- Don't use it to market consumer products to people in their personal lives. Don't send anything to a person's home address or personal phone unless the law allows it.
- No eligibility decisions. Don't use the data, alone or combined with other data, to decide anyone's eligibility for credit, insurance, employment, housing, a tenancy, a license or a government benefit. It is not a consumer report under the Fair Credit Reporting Act, and you must not treat it as one.
- Don't use it to harass, stalk, threaten or discriminate against anyone. Don't use it to find a person's home or to profile someone's personal life.
- Don't use it for anything illegal, deceptive or fraudulent, including phishing and impersonation.
2. Email: follow CAN-SPAM
US law allows commercial email to businesses without prior consent if you follow the CAN-SPAM Act. For every commercial email you send using our data:
- Use accurate "From", "Reply-To" and routing information that identifies your business.
- Use a subject line that reflects what the email is about.
- Say clearly that the email is an advertisement or solicitation, unless the recipient has consented to receive it.
- Include your valid physical postal address.
- Include a working way to opt out, such as a link or reply address, that works for at least 30 days after you send.
- Honor opt-outs within 10 business days and keep them honored. Don't sell or pass on the address of anyone who opted out.
- Don't use open relays, falsified headers or other ways to hide who sent the email.
Also:
- Don't add addresses from our files to lists that others send to.
- Don't generate new addresses from ours by guessing name patterns. Doing that can turn a violation into an aggravated one under CAN-SPAM.
- If you email people outside the US, follow their laws. Our data covers US businesses only.
3. Phones: follow the TCPA, the Telemarketing Sales Rule and state law
Where a list offers a phone line type (landline, mobile, VoIP or unknown), use it. Where it does not, treat any number as possibly mobile.
- No autodialed, prerecorded or artificial-voice calls, and no text messages, to mobile numbers unless you have the prior express consent the Telephone Consumer Protection Act requires. For marketing, that is prior express written consent. Business owners are protected too.
- Scrub before you call. Check any number that could be residential or wireless, including mobile and VoIP numbers and numbers of sole practitioners, against the National Do Not Call Registry and the state Do Not Call lists that apply. Keep your own internal do-not-call list.
- Follow calling-hour limits, caller-ID rules and the disclosure and misrepresentation rules of the FTC's Telemarketing Sales Rule. Its misrepresentation rules also cover calls to businesses.
- Follow state telemarketing laws where the person you call is located. Several states, such as Florida, Oklahoma and Maryland, have their own rules on automated calls and texts.
- Our files don't include Do Not Call status, and a line type, where a list offers one, is not a Do Not Call check.
4. Removal notices
When a person or business asks us to remove their data, we email you the affected records. You must:
- delete or suppress those records within 10 business days of our notice, in every copy and system that holds our data, including your email platform and CRM;
- keep them suppressed and never re-import them from our files;
- make sure the email address on your order receives our notices.
If someone who appears in our data asks you to stop contacting them, honor that too. You don't need to tell us, but you may.
5. No resale or sharing
- Don't sell, rent, license, publish, share or give away our data, in whole or in part, raw or merged into another list.
- Don't upload it to a data co-op, enrichment network, public website or shared database.
- Don't use it to build or improve a competing directory or data product, or to train a model that you sell or share.
- Service providers may process the data only for you, and a marketing agency only for the one client named on the order. Both are bound by these rules.
6. Protect the data
Keep the file in systems with access controls. Share it only with people who need it for the permitted purposes. Delete copies you no longer need. If the data is lost or accessed without permission, tell us at info@nodilist.com within 5 business days.
7. If this policy is breached
We may end your license, refuse future orders and ask you to delete every copy and confirm that in writing. Under our terms, you are responsible for claims that result from your use of the data.
Report misuse
If you think someone is misusing our data, email info@nodilist.com with what happened and, if you can, a copy of the message you received.
